Wine Equalisation Tax (“WET”) & Goods & Services Tax (“GST”)
The Customer shall be liable to pay all WET on the goods unless, at the time the goods are ordered, the Customer validly requests exemption and accordingly quotes to ‘The Legit Wine Company’ their Australian Business Number with their official order.
The Customer shall be liable to pay all GST on the goods.
Delivery
Minimum delivery 24 bottles
1-2 Cases $5/case delivery (where a case is equivalent to 9 litres)
3+ Cases Free into store (where a case is equivalent to 9 litres)
Claims
Must be notified at the time of delivery. Claims of any other nature will not be accepted unless made within 24 hours of delivery, with the exception of wine deemed to be faulty.
Payments & Passing of Property
Cheques and payments shall be made payable to ‘The Legit Wine Company’. Payments by cheque shall not be deemed made until the cheques have cleared.
All legal and beneficial rights of ownership, property and title to all goods (“the Goods”) supplied by ‘Legit Wine Company’ shall remain with ‘Legit Wine Company’ irrespective of the Customer taking possession of the Goods, and no such rights of ownership, property or title to the Goods supplied by ‘Legit Wine Company’ shall pass to the Customer unless and until the Customer has paid for the Goods by cleared funds.
Payments made by credit card will incur a surcharge, calculated as a percentage of the total invoiced amount. American Express transactions will incur a 2.5% charge. Mastercard and VISA transactions will incur a 1% charge.
In the event that payment is not made on or before the due date then the parties agree that ‘The Legit Wine Company’ may, at its discretion:
(a) charge interest on the outstanding sum at the rate of 2% per month, calculated daily, from the due date until the date of repayment; and
(b) suspend, until payment, all further delivery of Products
The Customer shall be liable for all costs of collection and legal fees incurred by ‘The Legit Wine Company’ in recovering amounts payable under this Contract.
Change of Particulars
The Customer shall give one month’s notice to ‘Legit Wine Company’ of any change in the name of any of its principals, its trading name, its licensee, its shareholders or (if the Customer is a company) its directors.
The Customer shall indemnify ‘‘Legit Wine Company’ against any loss or damage incurred by as a result of the Customer’s failure to notify ‘Legit Wine Company’ of any changes of these particulars.
General
Irrespective of any terms or conditions contained in the Customer’s order, and irrespective of the Customer not reading ‘Legit Wine Company’ Conditions of Sale, acceptance (by retaining the Goods or any other method) of the Goods ordered by the Customer will be conclusive acceptance of ‘The Legit Wine Companys’ Conditions of Sale.
